TVS Group files for Domain Dispute/INDRP over TVSgroup.in

TVS Group is an Indian diversified industrial conglomerate with its principal headquarters located in Madurai and presence across the Globe. The group name based upon it’s founder name Mr T. V. Sundaram (TVS) Iyengar.

INDRP Policy requires the following conditions to be fulfilled:

(i) the Registrant’s domain name is identical or confusingly similar to a name, trademark or service mark in which the Complainant has rights;

(ii) the Registrant has no rights or legitimate interests in respect of the domain name; and

(iii) the Registrant’s domain name has been registered or is being used in bad faith.

The famous TVS group already holds registered Trademark and TVSgroup.com, while .IN was held by Mr Rohit Kumar of Ghaziabad and the domain was registered in April 2015. The WHOIS nowhere indicates any legitimate interest of the Domain Registrant. The domain now shows as expired, so there is a least possibility that any legitimate use of the domain/website was ever being made.

Given the case for a famous brand as well, such matters require exemplary costs to be imposed, unless the Domain Holder is able to group some genuine reasons for registering the said Domain Name !
