1. HuntNews.in (154 pages) – INDRP/782 – Decided on June 29, 2016

Arbitrator: Mr. Ankur Raheja

Decision:
1. Therefore, the Arbitrator concludes that the Complainant has established all the three essential elements to maintain its complaint being that the disputed domain name is identical or confusingly similar to its Trademark NewsHunt ; the Respondent has no rights or legitimate interests in respect of the disputed domain name; the Disputed Domain Name was registered or is being used in bad faith.

2 Consequently the Arbitrator orders that in accordance with INDRP policy that the disputed domain name <huntnews.in> be transferred to the Complainant.

3. Further, in the peculiar facts and circumstance of the case, the Respondent is ordered to pay costs of Rs 1 Lakh to the Complainant.

2. Ducati.co.in (108 Pages) INDRP/834 – Decided on February 20, 2017

Arbitrator: Mr. Ankur Raheja

Decision:  

1. Therefore, the Arbitrator concludes that the Complainant has established all the three essential elements to maintain its complaint being that the disputed domain name is identical or confusingly similar to its Trademark DUCATI; the Respondent has no rights or legitimate interests in respect of the disputed domain name; the Disputed Domain Name was registered or is being used in bad faith.  

2. Consequently the Arbitrator orders that in accordance with INDRP policy that the disputed domain name be transferred to the Complainant.

3. Sensex.in (50 Pages) – INDRP/063 – Decided on August 17, 2008

Arbitrator: Mr. S Sridharan

Decision

1. For all the foregoing reasons, the Complaint is allowed as prayed for in the Complaint.

2. It is hereby ordered that the disputed domain name <sensex.in> be transferred to the Complainant.

3. Respondent is ordered to pay the Complainant a sum of Rs. 1,00,000/- (Rupees one lakh only) towards costs of the proceedings.

In Appeal, the award was upheld by Honorable Mumbai High Court.
