INDRP requires the three conditions to be fulfilled:

(i) the Registrant’s domain name is identical or confusingly similar to a name, trademark or service mark in which the Complainant has rights;

(ii) the Registrant has no rights or legitimate interests in respect of the domain name; and

(iii) the Registrant’s domain name has been registered or is being used in bad faith.

No doubt DELL is a strong trademark, therefore in such matters no legitimate purpose can be proved and also Bad Faith is mostly presumed as some sites are providing parking links, while others are using DELL logo !
